Rio Grande do Sul regulates take-back system of packaging

The Environmental Council of the State of Rio Grande do Sul published on December 5th, 2023 Resolution No. 500/2023 (Portuguese only), which sets forth the guidelines for implementation and operationalization of take-back systems of packaging in general in the State of Rio Grande do Sul.

The Resolution applies to manufactures, importers, distributors, and sellers of products (headquartered or not in the State of Rio Grande do Sul, and regardless of being party to a state commitment agreement) which, after usage by the consumer, generated packaging in general as waste in the State of Rio Grande do Sul. 

According to the Resolution, the Take-Back Certificates (regulated by federal legislation) will be accepted for the implementation and operationalization of take-back systems. 

A deadline of 120 days following the publication of the Resolution has been established for the state environmental agency to arrange the implementation and provision to interested parties of the registry of collective or individual models of take-back systems.

The Resolution demands that the Annual Performance Report must be submitted each year up to June 30th to the environmental state agency, considering the period of January 1st to December 31st of the preceding year.
