STATE OF MINAS GERAIS REGULATES TAKE-BACK SYSTEM FOR POST-CONSUMER GOODS AND PACKAGING

On February 9th, 2024, the State Council of Environmental Policy published Resolution No. 249/2024, which establishes guidelines for the implementation of Take-Back Systems (“SLRs” in the Portuguese abbreviation) for post-consumer products and packaging in the State of Minas Gerais.

The Resolution applies to manufacturers, importers, distributors and retailers of goods that generate postconsumer products and packaging in the state. Such resolution is not applicable if the postconsumer products are generated on rural properties and are inherent to agricultural and forestry activities.

The Resolution requires that the Take-Back Plans (“PLRs” in the Portuguese abbreviation), either individual or collective, must be formalized before State Secretariat for Environment and Sustainable Development (“SEMAD” in the Portuguese abbreviation), the State Environmental Agency. The PLR must be submitted by December 30th, 2024.

Furthermore, the Resolution sets forth that an Annual Take-Back Results Report must be submitted to the environmental state agency by July 31st every year demonstrating the results of the previous year.

Failure to comply with the guidelines established in the Resolution may generate environmental liabilities.
