INPI releases its regulatory agenda for the 2026–2028 triennium
The INPI (Brazilian Patent and Trademark Office) published on July 7th, 2026 INPI/PR Normative Ordinance No. 81, dated July 1, 2026. This ordinance updates the Regulatory Agenda of the INPI for the 2026–2028 period and becomes effective on the date of its publication.
Under the section covering matters to be developed through public calls for input and/or public consultations, the agenda includes: (i) the introduction of the concept of a “family of trademarks” into the Trademark Guidelines, scheduled for the first half of 2027; (ii) the expansion of the possibilities for industrial design registration, scheduled for 2027/2028; and (iii) the update of the guidelines for the activities of representatives/attorneys, scheduled for 2026/2027.
With respect to Regulatory Impact Assessment – RIA/AIR studies, the Ordinance identifies three topics: the protection of the intangible cultural heritage of traditional peoples against potential appropriation through trademarks and industrial designs, scheduled for 2027/2028; multiple claim sets in patents, scheduled for the second half of 2027; and the registration of electronic games, scheduled for the first half of 2027
As for Regulatory Outcome Assessment – ROA/ARR studies, the agenda focuses on the reassessment of rules and measures already in force. The topics include: the reassessment of INPI/PR Normative Ordinance No. 66/2026, which deals with categories for prioritized trademark examination, scheduled for the first half of 2027; the regulatory amendment that implemented the procedure for examining acquired distinctiveness in trademarks, scheduled for the second half of 2026; INPI’s Pricing Policy, including MDIC Ministerial Ordinance No. 110/2025, INPI/PR Ordinance No. 10/2025 and the amendment notice dated October 31, 2025, scheduled for the first half of 2027; the update of the administrative procedure for recordal and registration of technology agreements, under INPI/PR Ordinance No. 34/2025, scheduled for the first half of 2027; and the update of the examination guidelines for the recordal and registration of technology agreements, under INPI/PR Ordinance No. 35/2025, scheduled for the first half of 2028.
