The term of reference seeks to standardise the structure, and the minimum content of the waste management plan as well as the way to submit it to Cetesb for facilities requiring an environmental permit from the agency.

Under Federal Law No. 12,305/2010, which establishes the National Solid Waste Policy, the waste management plan is required for every facility generating wastes, except for commercial or service establishments generating non-hazardous, household-like waste under municipal legislation. In the absence of municipal legislation, Decision No. 130/2022/P establishes the 200 litres/day threshold for considering the waste generated by said establishments household-like.

The waste management plan must be formulated and implemented by a technical professional as well as revised periodically. In addition, the plan is to be submitted to the authority granting the environmental permit or by the competent municipal authority if the facility does not need and environmental permit. Collective plans are also possible, for example for facilities located in a condominium building.

In São Paulo State, Decision No. 130/2022/P provides that the waste management plan be submitted via Sigor, São Paulo State’s online waste management system.

As from 1 January 2023, financial institutions must standardise the way they register carbon credits and other sustainability assets in the accounting documents prepared after this baseline date.

The new regulation sets forth that these assets will be classified depending on how they will be managed by the financial institution, for example, if purchased for future sale and profit generation (CMN Resolution No. 4,967/2021) or used in their own activities (CMN Resolution No. 4,924/2021).

The CBB’s intention is to bring greater transparency to the sector in addition to monitoring investment portfolios and following up the evolution of these transaction.

By adapting the chart of accounts to contemplate the registration of sustainability assets, CBB NI No. 325/2022 contributes to the strengthening of said market, as it establishes clearer criteria for measurement by financial institutions and other institutions authorised to operate by the CBB.

The regulation is in tune with international accounting standards issued by the International Accounting Standards Board (‘IASB’).

The proposed decree repeals the 2015 sectorial agreement on packaging take-back as regards plastic packaging. Yet, the decree does not to apply to the packaging of medicines, pesticides, and lubricants.

Under the proposal, there are obligations for manufacturers, importers, distributors, and sellers of precursors (semi-manufactured plastic products), plastic packaging and products sold in plastic packaging.

In addition, collection/recycling targets for single-use plastic packaging are set both nationally (from 27,25% in 2023 to 40% in 2032) and by region. There is a specific calculation for verifying compliance with the targets, reusable packaging excluded therefrom.

There are also recycling content targets, which vary from 21% in 2023 to 30% in 2032.
