Term of reference for waste management plans in São Paulo state

São Paulo State environmental authority Cetesb has issued Decision No. 130/2022/P (Portuguese only) establishing a term of reference for the formulation of the waste management plans required in the environmental permitting procedure.

The term of reference seeks to standardise the structure, and the minimum content of the waste management plan as well as the way to submit it to Cetesb for facilities requiring an environmental permit from the agency.

Under Federal Law No. 12,305/2010, which establishes the National Solid Waste Policy, the waste management plan is required for every facility generating wastes, except for commercial or service establishments generating non-hazardous, household-like waste under municipal legislation. In the absence of municipal legislation, Decision No. 130/2022/P establishes the 200 litres/day threshold for considering the waste generated by said establishments household-like.

The waste management plan must be formulated and implemented by a technical professional as well as revised periodically. In addition, the plan is to be submitted to the authority granting the environmental permit or by the competent municipal authority if the facility does not need and environmental permit. Collective plans are also possible, for example for facilities located in a condominium building.

In São Paulo State, Decision No. 130/2022/P provides that the waste management plan be submitted via Sigor, São Paulo State’s online waste management system.
