State of Pernambuco mandates take-back schemes for packaging

The State of Pernambuco published on 24 December 2022 State Decree No. 54,222/2022 (Portuguese only) governing the implementation, setting up, and running of packaging take-back schemes. 

The decree applies to all manufacturers, importers, distributors, and sellers of products whose packaging is considered urban waste or household-like waste at end of life, regardless of whether companies are located or not in the State of Pernambuco.

The decree requires that a take-back plan must be filed with the state environmental authority by 23 December 2024. The yearly performance reports are to be submitted by 30 June of each calendar year.

In tune with Federal Decree No. 11,044/2022, State Decree No. 54,222/2022 creates the ‘Recycling Credit Certificate’, a packaging recovery note (PRN) system. Credits/notes may not be issued for wastes destined for energy treatment.
