Deadline for Rural Properties to Submit to the Environmental Regularization Program is Postponed

The Provisional Measure nº 1.150 (Portuguese only) published on 12/26/2022, amending article 59 of the Forest Code and establishing a deadline of 180 days for the rural landowners or possessors to submit to the Environmental Regularization Program (“PRA”), as of the subpoena from the competent body.

The PRA is an instrument to promote the regularization of environmental contingencies of rural properties, especially related to degraded Permanent Preservation Áreas (“APP”) and Legal Reserve Áreas (“RL”) that requires regularization.

Therefore, based on the MP, the rural landowners or land possessors may wait the end of the analysis of the properties’ Environmental Rural Registry (“CAR”) by the environmental body and the subsequent subpoena to adhere to PRA and start the regularization process of the contingencies identified during the CAR analysis.

The Provisional Measure should be voted by April 2, 2023 to turn into Law.
