Souto Correa’s Sanitation practice area comprises a team of professionals with in-depth knowledge of the regulatory, administrative, environmental, corporate, and contractual aspects of the sector in Brazil.
Our practice includes interdisciplinary consultancy and litigation counseling to national and international clients from the public and private sectors in matters involving water supply, sanitary sewage, urban drainage, urban cleaning, and solid waste management services.
Our team also provides counseling on legal aspects related to the development of municipal, state and regional plans for basic sanitation, training for sanitation workers, consultancy in designing projects on water reuse, land subdivision, water and sewage treatment and management of urban and industrial solid waste. We also act in arbitrations and defend clients in public civil actions and civil investigations.
Recent representations
- Consultancy to private companies in the participation in concession auctions to deliver sanitation services, Public-Private Partnerships (PPPs) and other contract models in many regions of the country;
- Legal counseling to a civil construction union on issues related to the regulation of approval of sanitary sewage projects with the state concessionaire and environmental licensing for these activities;
- Legal counseling to an investment fund manager to undertake a joint investment with a publicly-held company, which has a controlling interest in a number of basic sanitation concessions via public or private offering in another publicly-held company, which also has a controlling interest in the concessions;
- Defense of a private company in a public civil action, civil investigation, and proceedings before the Court of Auditors, discussing alleged environmental and regulatory infringements in the model for the provision of water and sewage treatment services in an important Brazilian capital city.
