With a multidisciplinary approach and dedicated exclusively to corporate matters, Souto Correa’s Labor area encompasses the nationwide management of court and administrative litigation, with the proper structure to manage ordinary and strategic labor lawsuits, such as claims filed by executives, public civil actions, class actions filed by labor unions, compensation claims due to labor accidents, occupational diseases, and arbitration proceedings.

Our team conducts the defense of companies in administrative procedures brought by the Ministry of Labor (MPT), such as preparatory procedures, civil investigations, and monitoring of Terms of Conduct Adjustment, as well as in inspections by the Ministry of Labor and Social Security on a number of topics, such as saving job vacancies for people with disabilities or for apprentices, moral harassment, outsourcing, collective dismissals, and working hours.

In the consultancy area, our team focuses on correcting and improving internal practices and policies by offering creative solutions to align clients’ interests and strategies with Brazilian legislation. Our team is skilled in reviewing labor practices to adapt company routines to comply with eSocial (government online platform for managing companies’ labor obligations) and LGPD, reviewing labor liabilities, conducting due diligence in merger and acquisition (M&A) transactions, reviewing and drafting contracts, policies, and codes of conduct, counseling on hiring international employees, expatriation, implementing hybrid and remote work models, structuring compensation and benefits models, developing alternative forms of hiring, and providing in-company training on labor law.

Our activities include handling relationships with labor unions and collective bargaining on a wide range of topics, such as work shifts, workday compensation, profit sharing, and collective dismissals.

  • Defense in a class action filed by a health care union claiming more than BRL 100 million in compensation;
  • Defense of a technology company in a public civil action filed by the MPT involving a claim in the amount of more than BRL 20 million;
  • Representation of an entertainment company with more than 3,000 employees in Brazil in three class actions involving a total amount of nearly BRL 27 million;
  • Legal counseling to a leading Brazilian manufacturer of agricultural machinery and equipment in implementing a labor debt restructuring, involving a total amount of nearly BRL 70 million in connection with more than 600 labor claims;
  • Representation of a leading Latin American investment bank in a labor claim brought by a former director involving a total amount of around BRL 52 million;
  • Legal counseling to a US-based medical manufacturing laboratory with operations in more than 150 countries in implementing arbitration provisions in employment contracts.
